How to Run an Oakland County Background Check

For criminal history in Oakland County, the best place to start is ICHAT at the Michigan State Police. ICHAT runs a name-based search against the statewide criminal history database. Each search costs $10 and covers felonies and serious misdemeanors from all 83 Michigan counties. Results come back right away. This is the tool most people use first.

Oakland County also has its own online court search system called Court Explorer. You can access it at courtexplorer.oakgov.com. This system lets you look up civil, domestic, felony criminal, and business court cases filed in Oakland County. You can search by name, case number, or other details. Court Explorer is run by the Oakland County Clerk. Note: Oakland County explicitly states that Court Explorer should not be used as a substitute for a formal criminal background check. ICHAT remains the proper tool for that purpose.

Oakland County Court System

Oakland County is served by the 6th Judicial Circuit Court, one of the busiest circuit courts in Michigan. The Circuit Court handles all felony criminal cases, civil cases over $25,000, family court matters, and business court filings. The Legal Records Division maintains case files for civil, domestic, felony criminal, and business court matters.

District courts in Oakland County handle misdemeanor criminal cases, traffic violations, and small claims. Several district courts operate across the county to serve different communities. Michigan ICHAT for Oakland County Searches

ICHAT, which stands for Internet Criminal History Access Tool, is maintained by the Michigan State Police Criminal Justice Information Center. A name search through ICHAT costs $10 per name. You pay by credit card and get results right away. The database covers all felonies and all misdemeanors punishable by more than 93 days in jail from every Michigan county.

What ICHAT does not include: warrants, suppressed records, juvenile records, traffic violations, tribal court records, federal criminal records, and crimes from other states. The Clerk's Legal Records Division holds civil, domestic, felony criminal, and business court case files for Oakland County. You can request copies in person or submit a written request by mail. Under MCL 15.234, the county can charge reasonable fees for copying records. Standard copies run $1.00 per page. A certified copy adds a $10.00 fee. Sheriff's Office and Local Records

The Oakland County Sheriff's Office handles local law enforcement records, including arrest logs and incident reports. What Oakland County Background Check Records Contain

A background check in Oakland County can pull from several sources. ICHAT shows criminal charges, dispositions, and sentences for felonies and serious misdemeanors statewide. FOIA Requests in Oakland County

Michigan's Clean Slate laws allow automatic sealing of certain convictions after waiting periods pass. Misdemeanors can be sealed after seven years. Some felonies qualify after ten years. Once sealed, the record will not appear in ICHAT, Court Explorer, or other public searches. This affects background checks in Oakland County the same as everywhere else in Michigan.

Juvenile records can be sealed under Public Act 362. If a record appears to be missing, it may have been sealed. Sealed records are still accessible to law enforcement. They are not available to the public or through standard background check tools.
